“It means any non-citizen, and there are millions of them, can be whisked off at night and be put in detention.”

The new law says that enemy combatants will be tried before military commissions, not a civilian judge or jury, and establishes different rules of evidence in the cases. It also prohibits detainees from challenging their detention in civilian court.

  3. This is merely an extension of the recent White House bill that destroyed the writ of Habeus corpus. So unless Congress decides to overturn the bill and show some modicum of reverence towards the document they swore to defend and protect, expect more such laws to pass. Of note, the John McCain bill that in theory opposed the White House bill regarding torture, also called for an end to Habeus corpus. It’s nice to know that ruling powers during the era of the Magna Carta had more sense of justice than our present ones.
